These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy within these Terms and Conditions. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

All artworks listed here are created by the artist, Rachel Varden. No artwork, or images of it, must be used for commercial purposes without permission from the artist and full credit must be given to Rachel Varden.

RIGHTS TO CANCEL/RETURNS POLICY 

You may cancel your contract with us for Artwork you order at any time up to the end of the 14th day from the date you receive the Artwork.

You do not need to give us any reason for cancelling your order nor will you have to pay any penalty. It does not affect your statutory rights. 

To cancel your contract you must notify us in writing by email to info@rachelvarden.com 

If you have received the Artwork before you cancel your order you must send the Artwork back to our contact address at your own cost and risk. We suggest you send this recorded or via courier as we are unable to refund artwork that isn’t received/is lost in transit.

If you cancel your order but we have already processed the Artwork for delivery you must not unpack the Artwork when they are received by you and you must send the Artwork back to us at our contact address at your own cost and risk within 14 days of cancellation 

Once you have notified us that you are cancelling your contract, any sum debited to us from you will be credited to the payment method used to purchase the order as soon as possible and in any event within 30 days of your order provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you.

If you do not return the goods delivered to us or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the Artwork from the amount to be credited to you. 

MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the product/service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

PAYMENT

All payments are due upon receipt. If a payment is not received or payment method is declined, the buyer forfeits the ownership of any items purchased. If no payment is received, no items will be shipped.

ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

PROHIBITED USES

Shipping Policies

Shipping will be paid for by the buyer in the amount agreed upon by the seller at the time of purchase. If an item is lost during shipping, the total cost of item, including shipping, will be refunded to the buyer by the seller. If an item is damaged during shipping, seller will not be held responsible but proof must be provided.

COMMISSIONS

Art Commissions are undertaken when all parties are in agreement they are happy to proceed via email info@rachelvarden.com – no work will proceed until a 50% deposit has been paid – the final payment of the remaining 50% due must be paid prior to the goods being shipped – any postage/shipping costs will be paid in addition to the cost of goods dependant on the country and cost of shipping agreed by all parties prior to distribution
